Who is the data controller?

To what end and on what legal basis will EDM process your personal data?
EDM will process your personal data to address any requests or queries you submit through our website or you ask any of the members of our team. We also process your data in order to invite you to our seminars, send you our newsletter, and provide you with information about the investment and financial sector.
EDM will only process your data with your prior consent. Your consent serves as the legal basis for this processing. As such, EDM will only process the personal data you provide us: your name, surname(s), and email address.
Legal entity point persons
If you provide your data in the course of acting on behalf of or as the point person for a legal entity (i.e.: a commercial company or foundation, etc.), EDM will process your personal data for the sole purpose of maintaining communications with the legal entity in question.
Under no circumstances will EDM use your personal data to send you — as an individual — promotional materials, unless expressly authorised.
How long will EDM retain and process your personal data?
EDM will process your personal data until you withdraw your consent.
Withdrawal of your consent (an option available at any time) will in no way affect your potential relationship with EDM, or your relationship until that point. In this instance, EDM would simply stop sending you promotional materials.
Thereafter, EDM will retain your personal data, duly blocked, to address any potential claims or to furnish them to any public administration or authority that may request it, for the legally prescriptive period only.
Which recipients might receive your data from EDM?
As a general rule, unless legally mandated, EDM will not share your personal data with any third-party.
However, EDM collaborates with third-party service providers who may have access to your personal data (i.e.: companies that manage EDM’s IT systems). However, these service providers will process your data according to our instructions at all times and only to provide us with the services contracted.
What are your rights?
The law recognises your rights of access, portability, rectification, erasure, objection to and restriction of data processing, as well as your right not to be subject to fully automated decisions. These rights can be exercised by email at dpo@edm.es or by post at Avenida Diagonal 399, Barcelona 08008, or Paseo de la Castellana 78, Madrid 28046.
Likewise, you are informed that your data will not be subject to commercial profiling or automated decision-making.
Finally, you file a complaint with the EDM and/or the Spanish Data Protection Agency if you have not obtained satisfaction in the exercise of your rights, by writing to the above address or visiting https://www.aepd.es.
3. Third Parties Linked to the Client
EDM GESTIÓN, S.A.U S.G.I.I.C. (hereinafter, “EDM”), as the legally responsible entity, informs you that it will process your personal data in your capacity as a family member, legal representative, beneficial owner, indirect controlling party of the company, authorized individual with consultative access to the Client Area of EDM’s website, administrator, attorney-in-fact and/or shareholder of one of our Clients, who has provided us with your personal data within the framework of contracting a product or service with EDM, and for the purpose of delivering this data protection information clause.
In this regard, EDM will process your personal data as the legally responsible entity, in order to properly verify and confirm your identity in your capacity as a family member, legal representative, beneficial owner, indirect controlling party of the company, authorized individual with consultative access to the Client Area of EDM’s website, administrator, attorney-in-fact and/or shareholder of our Client. This information is required to be processed by EDM in order to comply with the provisions of Law 10/2010 on the Prevention of Money Laundering, within the scope of executing the contract signed with the Client.
Additionally, with respect to third parties with consultative access to the Client Area, EDM will process your data for the purpose of managing such access permissions, allowing consultation of investment positions. These permissions will remain in effect until authorization is withdrawn by the Client.
The personal data of third parties linked to the Client will not be disclosed to any third party, except when legally required by public authorities, official bodies, or banking supervisory entities. Your personal data will not be used for any other purpose.
Furthermore, we inform you that current data protection regulations grant you the rights of access, rectification, erasure, objection, and restriction of processing, as well as the right not to be subject to a fully automated decision, all when legally applicable. You also have the right to file a complaint with the Spanish Data Protection Agency if you believe your rights have been violated.
